Judge releases Dahl on bond

FORT PIERRE — A Fort Pierre man facing felony and misdemeanor charges in four different incidents was released on bond Wednesday after completing alcohol treatment.

Magistrate Judge Mark Smith set a $5,000 bond for Flint Dahl, 22, but required Dahl to submit to twice-daily alcohol testing as a condition of his release.

Dahl, who face charges of stealing and harming a rodeo horse named Dually, is not allowed to consume alcohol, marijuana or any other controlled substances or to violate any laws.

Dahl faces felony and misdemeanor charges in the horse case. In three separate incidents, he is accused of ingesting marijuana, not reporting an automobile accident and getting into an altercation with a law enforcement officer.

He had been released on bond until November, when his bond was revoked for ingesting marijuana and alcohol.

In December, judge Smith approved Dahl’s transfer to the Human Services Center in Yankton for alcohol treatment.

Dahl’s attorney Bernard Duffy told Smith Dahl is a changed man.

“I think he’s on the mend, if that’s the proper phrase,” Duffy said. “He is not blaming anybody for anything, and he just wants to get off substances and drugs and whatever’s out there that he’s been involved with before.”

State’s attorney Thomas P. Maher agreed to support Dahl’s release on bond, but asked Smith to require twice-daily alcohol tests under the state’s 24/7 Sobriety Program.

“Actions speak much louder than words. That’s what the 24-7 is,” Maher said. “If he was under the influence or if he wasn’t following a regular routine we would know about it. It’s a way to monitor his actions and it’s a way to keep a check on his alcohol or lack of alcohol.”

Smith said Maher’s recommendation changed his mind about renewing Dahl’s bond.

“When I came in here, my plan was not to change your bond or set a bond,” Smith said. “If the state’s attorney — who knows more about these cases than I do — is willing to make that recommendation, I’m willing to listen to it.”

Every morning and every evening, Dahl must take a breathalyzer test. If he doesn’t take the test or tests positive for alcohol, he faces the revokation of his bond.

Dahl told Smith he is employment at a ranch around 40 miles west of Fort Pierre and sometimes spends the night there if he works late.

Smith said Dahl would need to come back each night but could take his alcohol test at the Hughes County Jail if it was after hours.

Dahl’s next court date is Feb. 10 at 2 p.m.
